Cyberlandia Terms of Use

1. Introduction
These Terms of Use (“Terms”) govern your access to and use of Cyberlandia’s services, products, websites, and applications (collectively, the “Services”). By using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must discontinue use immediately.
2. Eligibility & Accounts
– You must be at least 18 years old to use the Services.
– You agree to provide accurate, complete, and current information when creating an account.
– You are responsible for maintaining the confidentiality of login credentials and all activities that occur under your account.
– Cyberlandia reserves the right to suspend or terminate accounts with inaccurate or unlawful use.
3. License & Use of Services
Cyberlandia grants you a limited, non-exclusive, non-transferable license to use the Services for your internal business or personal use. You may not:
– Resell, sublicense, or share Services without prior written consent.
– Reverse-engineer, decompile, or copy the Services.
– Use the Services for unlawful, harmful, or fraudulent activities.
– Introduce malicious software or attempt unauthorized access.
4. User Content & Responsibilities
– You retain ownership of data and content you submit but grant Cyberlandia a license to use it solely for providing and improving the Services.
– You must ensure all use complies with applicable law, including data protection, export/import restrictions, and intellectual property laws.
– You agree not to transmit spam, malware, or other harmful content through the Services.
5. Intellectual Property
– All intellectual property in the Services remains the property of Cyberlandia and its licensors.
– You may not use Cyberlandia’s trademarks, branding, or proprietary materials without express written consent.
6. Confidentiality & Privacy
– Both parties will protect confidential information exchanged through the Services.
– Cyberlandia may analyze anonymized and aggregated data for security, compliance, and service improvement.
– Personal data is handled in accordance with the Cyberlandia Privacy Policy.
7. Payment & Fees
– Fees are due as stated in your subscription or purchase order.
– Cyberlandia may suspend Services for non-payment.
– Fees are non-refundable unless required by law.
8. Service Availability & Suspension
Cyberlandia may modify, suspend, or terminate Services at any time for legal, security, or technical reasons. In case of non-payment, breach, or unlawful activity, Services may be suspended immediately.
9. Warranties & Disclaimers
– Services are provided on an “AS IS” and “AS AVAILABLE” basis.
– Cyberlandia disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
– Cyberlandia does not guarantee that Services will be error-free, uninterrupted, or that all threats will be detected or blocked.
10. Limitation of Liability
To the fullest extent permitted by law:
– Cyberlandia is not liable for indirect, incidental, special, punitive, or consequential damages, including loss of data, profits, or business.
– Cyberlandia’s total aggregate liability for any claim shall not exceed the subscription fees actually paid by you to Cyberlandia during the month in which the claim arose, calculated on a pro rata basis.
11. Indemnification
You agree to defend, indemnify, and hold harmless Cyberlandia, its affiliates, officers, directors, employees, and agents against claims arising from your use of the Services, including violations of these Terms or applicable law.
12. Termination
– Cyberlandia may terminate or suspend your access at any time, without notice, for breach of these Terms or other reasons at its discretion.
– Provisions relating to IP, confidentiality, disclaimers, limitations of liability, and indemnification survive termination.
13. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Ohio, USA. You consent to the exclusive jurisdiction of the courts located in Ohio for any dispute arising out of or relating to these Terms.
14. Changes to Terms
Cyberlandia reserves the right to update these Terms at any time. Continued use of the Services after revisions are posted constitutes acceptance of the new Terms.
